Nicolette van der Walt

Nicolette van der Walt is an Associate at ENS in the Banking and Finance practice.
Nicolette specialises in corporate finance transactions, debt finance (including preference share funding) and related security structures, as well as general corporate and commercial law.
Her experience includes advising on financing transactions, transactional and regulatory matters, pension fund compliance and governance, business rescue and insolvency proceedings and the drafting, reviewing, negotiating and implementing of agreements.
In addition, Nicolette is also experienced in a wide range of corporate and commercial transactions, including mergers and acquisitions, corporate restructures, due diligence investigations and the drafting, reviewing, negotiating and implementing of commercial agreements, including memoranda of incorporation and shareholders’ agreements, as well as advising homeowners’ associations on their governing documents and general scheme governance, advising clients on POPI and the National Credit Act, and further attending on general contractual disputes, including arbitration and commercial civil litigation proceedings, as well as negotiating and drafting settlement agreements and has advised clients in the agricultural, commercial, corporate, financial, hospitality and entertainment, property, medical, healthcare and pharmaceutical and transport and logistics sectors and/or industries.
Nicolette is a member of the Legal Practice Council of South Africa.
