Stephen Motsusi is an Associate in ENSafrica’s Natural Resources and Environment practice. He has experience in Corporate, Mining and Energy Law.

Stephen specializes in mergers and acquisitions, general corporate and commercial law in the mining and resources sectors and upstream and midstream oil and gas matters including regulatory and compliance in Africa.

Stephen’s mining and environmental law related experience includes advising on mining and environmental due diligences, drafting service level agreements, mining contract agreements, access and use agreements and various statutory applications such as applications in terms of the National Environmental Management Act, 1998; the Mineral and Petroleum Resources Development Act, 2002 and Precious Metals Act, 2005. Stephen also advises clients on mining M&A transactions (including  share purchase and asset purchase agreements), surface and land use arrangements, mining law disputes.

Stephen’s oil and gas experience includes advising on upstream due diligences, various upstream and midstream issues and upstream and midstream agreements, including production sharing agreements, LNG sales and purchase agreements, joint operating agreements, 3D seismic survey agreements and LNG tolling agreements among others.

Stephen’s vocational training involved exposure to private M&A, private equity and various types of financing transactions including secured lending, cross-border financing, project finance and syndicated lending in the power and energy (including renewable energy), mining, natural resources and infrastructure sectors in South Africa and in various jurisdictions throughout Africa.
