Siphile Hlwatika is a Senior Associate at ENS in the Employment practice. He specialises in employment litigation and general employment law.
Siphile has acted for clients in a variety of industries in the public and private sectors, including the agricultural, automotive manufacturing, aerospace and defence manufacturing, aviation, fast-moving consumer goods, construction, energy, engineering, financial services, healthcare, hospitality, mining, retail and telecommunications industries.
Siphile’s experience includes advising clients on various employment law-related issues such as collective bargaining, employment equity, industrial action, organisational rights, pension funds, transfers of employment in terms of section 197 of the LRA, unfair discrimination, unfair labour practices and unfair dismissals.
His experience also extends to assisting and representing clients in disciplinary proceedings and employment-related litigation before the Commission for Conciliation, Mediation and Arbitration (“CCMA”), various bargaining councils, the Labour Court and Labour Appeal Court. His experience further extends to chairing disciplinary hearings and conducting investigations and drafting reports in relation thereto.
