Hassan van Wyk is a Senior Associate at ENS in the Employment practice and specialises in all aspects of employment law.

Hassan has acted for a number of clients in the retail and wholesale, mining, energy, construction and engineering, manufacturing, insurance and banking industries and has also acted for state departments, state owned companies and bargaining councils in the public sector.

Hassan has advised and acted for clients in litigious and non-litigious employment law related matters including matters relating to employment equity, unfair discrimination, workplace misconduct, unfair labour practice disputes, retrenchments/redundancies, transfers of employment in terms of section 197, organisational rights disputes and matters relating to collective bargaining and industrial action.

Hassan regularly assists clients in employment law related litigation in the CCMA, Bargaining Councils, Labour Court, Labour Appeal Court and Constitutional Court. Hassan has appeared personally on behalf of clients in the Labour Court and CCMA. 

Hassan has a keen interest in restraints of trade and has advised and acted for clients in matters concerning the enforceability of restraints of trade in the Labour Court. 

In addition, Hassan has assisted clients with drafting bespoke employment related agreements including contracts of employment, independent contractor agreements, collective agreements and separation agreements for senior employees and executives.
