Hassan van Wyk


practical experience
Hassan van Wyk is an associate in ENSafrica’s employment department. He specialises in all aspects of employment law and labour law.
Hassan has acted for a number of clients in the mining, energy, construction and engineering, retail and fast moving consumer goods industries. Hassan has also acted for a number of state departments and state owned companies.
Hassan’s experience includes advising clients on various employment law related issues such as employment equity and unfair discrimination, disciplinary proceedings, unfair labour practice disputes, unfair dismissal disputes, restraints of trade, retrenchments, transfers of employment in terms of section 197 and changes to terms and conditions of employment. Hassan also has experience in advising clients on issues related to organisational rights, collective bargaining and industrial action.
Hassan has experience in drafting a number of employment related contracts including contracts of employment, independent contractor agreements and recognition and collective agreements. In addition, he has assisted clients in employment law related litigation in the Commission for Conciliation, Mediation and Arbitration, Bargaining Councils, Labour Court, Labour Appeal Court and Constitutional Court.
