Willem van der Colff

Willem van der Colff is an Executive at ENS in the Dispute Resolution practice.
Willem specialises in general, commercial, and criminal litigation. His expertise covers insurance litigation, company law, agribusiness, and contractual and delictual matters. He regularly advises on complex arbitrations, provides legal opinions, and drafts key documents, and advises on directors' liability, shareholder disputes, and reportable irregularities under the Auditing Profession Act.
A former Public Prosecutor within the Department of Justice, Willem has extensive experience in high-profile criminal cases and white-collar crime, including anti-bribery, corruption, compliance, and forensic investigations. He represents accused individuals, complainants, and victims, and frequently advises on reporting obligations and regulatory compliance.
Willem was recently seconded by ENS to the National Prosecuting Authority (NPA) to assist with strengthening the Rule of Law and to provide project management support.
His industry expertise spans agribusiness (including water and environmental disputes), technology, media, telecommunications, and tax litigation (both civil and criminal). He provides strategic legal counsel on contractual and delictual claims across multiple sectors.
Willem has represented private individuals, multinational corporations, and major national companies in litigation across Sub-Saharan Africa. He was elected to and previously served as a councillor and Manco member on the Western Cape Provincial Legal Practice Council.
