Vanesha Babooa-Bissonauth

Vanesha Babooa-Bissonauth is an Executive at ENS in Mauritius. She is however based in Johannesburg, South Africa and working remotely with the Mauritius office.
She is involved in litigation and arbitration across a number of areas of law, including civil law, commercial law, banking law, insolvency law, employment law and shipping law. She has assisted clients with matters before all lower Courts in Mauritius, the Supreme Court of Mauritius and its various divisions, the Judicial Committee of the Privy Council and the COMESA Court of Justice. She has considerable experience in drafting of pleadings in relation to proceedings before these Courts. She regularly assists with various Court procedures such as plaints, injunctions, judicial reviews, enforcement of judgments, attachments, seizures, winding up and bankruptcy petitions, water rights applications and so forth.
Vanesha has handled major cross-border litigation matters, including arbitrations set up under the ICC Rules and the MARC Rules. She has also been involved in a number of applications in respect of foreign arbitral awards and incidental applications in aid of international arbitration. She has acted as rapporteur during an international arbitration conference in Mauritius and has contributed to an article for the ICCA.
She specialises in shipping law related matters and has previously advised various clients in the industry, including international law firms and P&I Clubs. Advice has been provided on a variety of shipping issues, whether in the context of a litigation or not, including issues relating to limitation of liability, setting up of limitation funds, maritime claims, removal of wrecks, applicable conventions in Mauritius and ship arrests. Vanesha has successfully applied for vessel arrests and releases on many occasions and also obtained a ground-breaking disclosure and preservation of evidence interim order against a vessel.
