Theo Buchler is an executive at ENSafrica in the dispute resolution department and specialises in general commercial transactions and litigation, the latter almost exclusively in the High Court and at arbitration (local and international).
Theo has spent a significant amount of time analysing and conducting litigation under the National Credit Act. He has advised clients on the impact of same on their operations and proposed transactions, and has drafted numerous credit agreements to conform to the Act and Regulations there under. Theo, furthermore, undertakes opinion work on the National Credit Act for clients, including financial institutions and the National Credit Regulator.
Theo’s other experience includes matters involving banking and finance litigation (particularly interest claims), restraints of trade, building and construction, lease and loan (and securities thereunder) recoveries, general contractual disputes, insolvency litigation and practice, shareholder and director disputes, administrative law disputes predominantly under the Promotion of Administration Justice Act, as well as general litigation. He also has proficiency in the drafting of commercial finance agreements (mostly loan/facility agreements and related security documentation such as suretyships, pledges of shares and loan accounts) and relationship agreements (such as paymaster) within the construction industry.
Theo works closely with the Banking and Finance, Tax, Corporate Commercial and Forensics departments at ENSafrica to assist with matters which require the input of a dispute resolution practitioner.
