Shivani Moodley is a Senior Associate in ENSafrica’s Employment department. She specialises in employment litigation and advising clients on their statutory obligations in terms of South African employment legislation.
She has acted for clients in a variety of industries including the mining, finance, renewable energy, manufacturing, retail and media industries, as well as various public sector entities.
Shivani’s experience includes advising clients on employment litigation in the Commission for Conciliation, Mediation and Arbitration (“CCMA”), the Labour Court and the Labour Appeal Court, as well as conducting reviews of CCMA, bargaining council and Arbitration Foundation of South Africa awards. She also assists clients in matters concerning, poor performance, misconduct, retrenchments and internal grievances.
Shivani also has expertise in drafting contracts of employment, workplace policies and procedures, settlement and separation agreements, and applications for registration as a temporary employment service or recruitment agency.
She has conducted a number of due diligence investigations in relation to the employment components of commercial transactions.
