Ryan Goodman is an Executive at ENS in the Competition practice. He has significant experience in all aspects of competition law in South Africa, including statutory merger notifications, complaint proceedings, cartel conduct and regulation of prohibited practices, abuse of dominance, exemption applications and the corporate leniency regime, as well as performing audits of companies. He is also closely involved with competition-related litigation.

Ryan has also developed expertise in competition law in various African jurisdictions (including the regional regulatory body, COMESA), and has assessed, filed mergers with and provided prohibited practices advice in various African jurisdictions including in Botswana, the Kingdom of eSwatini, Namibia, Tanzania, Zambia and Zimbabwe.

Ryan has acted for various large local and international companies in the corporate, retail, banking, insurance, mining, construction, telecommunications, aviation, pharmaceutical and financial services sectors. 

Ryan has been involved in a number of seminal competition law cases in South African.  For example, from a mergers perspective, this includes being part of the team who acted for an engineering services group (in liquidation) in relation to a sale of business / assets to a construction group which resulted in one of the quickest turn-around times from the Competition Tribunal for the approval of a large merger under public interest considerations. 

From a behavioural perspective, Ryan was part of the teams that acted for an FMCG company in the bread cartel and the Retail Market Inquiry, for a bank in the first voluntary market inquiry, namely the Commission’s Banking Inquiry, for a chemical manufacturing company in the Commission’s LPG Market Inquiry; for an insurance group in the Commission’s Health Market Inquiry and for a tax finance company in the Commission’s Public Passenger Transport Market Inquiry.  He was also part of the team representing a glass group in relation to the Commission’s dawn raid and subsequent investigation and acted for a technology-led, data-driven provider of services & capital solutions company in its successful defense against a complaint initiated by the Competition Commission in relation to alleged excessive pricing on the part of one of its finance divisions.

Ryan is currently involved in various matters in Africa, including forming part of the team that is advising on the first gun jumping, abuse of dominance and collusion cases in Namibia. 

He is the author of competition law related articles for Business Law and Tax Review and is a contributing editor of the Butterworth’s Competition Law Reports.
