Darren Smith is a Senior Associate at ENSafrica in the Competition / Anti-Trust department.
Darren specialises in advising on the notifiability of proposed transaction structures and merger notifications to the competition authorities in various African jurisdictions complaint proceedings, general competition law advice regarding cartel conduct and prohibited practices and abuses of dominance, the Competition Commission’s corporate leniency regime, performing competition law compliance audits and competition due diligence investigations, and competition law compliance training.
His expertise expands to Namibia, Mauritius, Tanzania, Nigeria, Mozambique, and Zambia, as well as the Common Market for Eastern and Southern Africa in considering the notifiability (from a merger perspective) of a transaction involving firms in the fruit logistics industry to the COMESA Competition Commission and interaction with the Manager of the Merger and Acquisitions and Manager of the Enforcement Division of the COMESA Competition Commission.
He has acted for various large local and international firms in, inter alia, the following sectors: corporate, retail, banking, property, mining, aviation, agricultural / fishing / forestry, financial services and construction sectors.
Darren is the author of competition law related articles for the Business Law and Tax Review, a contributing editor of the Butterworth’s Competition Law Reports and has published an article in the South African Journal of Human Rights.
