South Africa: Occupational Health and Safety Act, 1993 – Publication of the Occupational Health and Safety Amendment Bill, 2020
On Friday, 14 May 2021, GN. 422 of 2021 was published in Government Gazette No. 44572, in terms of which the Minister of Employment and Labour gave notice (in terms of Rule 276(1)(b) of the Rules of the National Assembly), that he intends introducing the Occupational Health and Safety Amendment Bill, 2020, to the National Assembly.
According to the General Explanatory Summary and Note (which can be found on pages 111 and 113 of the Notice), the Occupational Health and Safety Amendment Bill, 2020, seeks to amend the Occupational Health and Safety Act, 1993, so as to:
- delete, substitute and insert certain definitions;
- effect certain technical corrections;
- make further provisions in respect of the health and safety of persons at work and the health and safety of persons in connection with the use of plant and machinery;
- further regulate the protection of persons other than persons at work against hazards to health and safety arising out of or in connection with the activities of persons at work;
- further regulate the composition of an advisory council for occupational health and safety; and
- provide for matters connected therewith.
The Bill does not make provision for an invitation for public comment at this point in time. We are taking steps to obtain more information in this regard and will publish a separate communication with this information, where required.
